Quiet title action can be done in all 50 states. Sometimes there are deeds that have been transferred but contain mistakes or errors that exist on public records that need to be resolved. However, in some cases, the person who can settle that issue is not reachable or in the worst-case scenario is already deceased

Lou, we had a question from one of our viewers and the question was from Eric Bonner. “What would it cost to quiet a title in Georgia?”

Lou Brown:

Well, a quiet title action. First of all, what is a quiet title action? Many of you have probably never heard of a quiet title action. Well, it can be done in all 50 states. And what it is, is that sometimes deeds are transferred and there’s mistakes. There’s errors that exist on public record that have to be resolved. However, someone may have died that could resolve that issue. There could have been a transfer earlier at another time and the people are not findable. How do you resolve that issue? While it does involve the courts, it does involve being able to connect the dots in what’s called the “chain of title.” And this is about the only thing that you can do to band-aid a mistake, a break in the chain of title. And that is what’s called a “quiet title action.” So a quiet title action can be somewhat expensive depending on the state that you’re in because it does involve the courts.

It often involves attorneys, although it’s not a requirement that you get an attorney for it, it’s just a matter of “here are the issues and here’s what we are asking the court to do.” And provided that you’ve done the steps that are required in your state, then the court can go forward with that quiet title action. So again, you could do that yourself, or you want to try to find someone who specializes in quiet title actions. Now there’s not many of them and you may have to look long and hard, which is a reason that they’re often expensive because it’s kind of a specialist-type thing. Like just think about a doctor and them having a specialty. So this is another example of what can happen is that it can cost anywhere from say $1,500 to $5,000 to do a quiet title action, just depending on whom you get to do that and the complexity of the problem that you’re trying to resolve.
