Lou. I remember you saying once that there were ways to buy houses for $10. Is that really possible?

Lou Brown:

That’s a great question. In our world, what happens is that you talk with sellers, you get the details about their existing financing. You discover that by the time you get through all the costs to sell the property, you actually end up with a number. Once you take into account the mortgage on the property, you actually end up with a negative number. And if it’s a negative number, that’s an opportunity to buy the house for what we call $10, which is consideration on a contract. And in many cases, sellers will actually pay you to buy their house. Now, why would they do that because of the numbers? And if you don’t believe it’s possible for a seller to pay you to buy their house, just call any title company that you know in your local area and ask them the question. Do you ever see people come to a closing with a check where they actually have to pay to sell their house?

And what you’ll hear is only all the time. So as a result of that issue coming up for people, we know that when we sit down with a seller and counsel with them and educate them on the costs to sell. Generally speaking, when they see those numbers, they’re going to accept those numbers and know that they’re real. And the same is true. When you get and take into account an existing mortgage on the property, then buying it for $10 is absolutely possible. Now, the other possibility also is bad paperwork. So sometimes banks played some games and some shenanigans with a lot of people’s homes. And when we look at the paperwork, we actually discover that the paperwork is bad. And so that can create an opportunity for a settlement at a later date. And sometimes people don’t have the time, energy or money to defend on a lawsuit like that.

So they will go ahead and sell you. They’re upside down house, the bank loan 700,000, but it’s only worth 500,000. So there’s a big loss in there for somebody. And people sometimes are ready to go on with their lives. They don’t want to deal with this anymore. If you’ll take it on, that’s another example of a $10 house where you take it on and now you negotiate, you take on their litigation rights, they actually sell you their litigation rights. And then you litigate with the bank to determine a number that will be agreeable to both of you. And then that process can take years. In fact, and a lot of sellers just say, “Look, if you’ll take this off my hands for $10, I’ll be happy with that.” So, there’s another example of a $10 house.

Do you have the seller put their property in a trust, then do the closing when I have a buyer or is it all done at the same time at closing?

If you are purchasing from a seller, well, I’m saying you’re not purchasing. What the seller does is the seller does place their property into their trust. What you purchased is the beneficial interest of the trust, or perhaps your trust. Another trust like a personal property trust, for example, could purchase the beneficial interest of that land trust. Well, in Land Trust, that differential that occurs in a land trust is that the beneficial interest is personal property. It’s not real estate. So, that’s what you’re really purchasing when you’re doing a property subject to the existing loan.

Can I start my business as a trust rather than an LLC?

Lou Brown:

Great question. The answer is yes, there is such a thing called a Business Trust and a Business Trust can operate. And in fact, we have a number of clients that have chosen to have business stress. Why? Because they have a business. We have doctors and CPAs and multiple different professionals that have businesses up and running. And they’re operating those now as Business Trusts and then separately with their real estate, their passive income assets, they have those in the Elite Trust. So, you can have a Business Trust. And in fact, the Elite Trust can have up to a 90% share of the Business Trust as well. So, that’s passive income to the Elite Trust that’s coming from the Business Trust. So that’s a good structure when you have an existing business, that’s up and running.

JB asked a really good question. I think he has an Elite Trust. Do any of these taxes apply to my estate if I have an Elite Trust?

Lou Brown:

No. What happens is that when you sell whatever assets you have to trust you’re selling them at your basis in those assets. So, there’s no taxable event for those to be purchased by the trust. And the trust gives back a note to you. So, if you ever needed to have some money outside of the trust, then you could simply ask the trust to pay you for that note that the trust owes you. So, that’s one way that you can get money out of the trust is simply have a note outside the trust, but inside the trust, the trust can make as much money as the trust can make, basically through the sale of those assets, through the use of those assets, through the renting of those assets, that kind of thing, and the benefits remain inside the trust. So, if they have taken advantage again of the tax code, and this is in the tax code in the six hundreds part of the tax code, I was telling you about earlier that allows for these assets to be able to pass and allows for the funds in that trust to be able to continue and pay its bills and what have you, without there being a taxable event.

Excellent. So we have one last question we’re just running out of time and make sure by the way you join us every Wednesday at one o’clock, 1:05 Eastern we go live in Technicolor, same bat channel, same bat time, and Mary Ann, you get the honor of the last question. 

Scott Paton:

If my house is in a land trust, and it’s worth 600,000 and I pass away, how much Inheritance Taxes my beneficiaries have to pay?

Lou Brown:

Under current laws, none. And that’s the federal level. It’s also subject to State Taxes. Now, different States have different rules for what the state charges on. And like I said earlier, there could be Inheritance Tax. There could be a State Tax. So, depending upon which state you’re in, there could actually be a double tax at the state level. But at the federal level, under current laws, there is no Inheritance Tax.

Scott Paton:

Now, there would be probate, right?

Lou Brown:

There would be probate. So the good news is, if you have your property in trust, as you suggested, then that would avoid probate. That would avoid probate because you already decided who’s going to get it. So therefore, you don’t need any courts, any judges, any attorneys, any delays or an expense you’ve already set up your trust. You’ve already said, who’s going to get it. And therefore, the operation of probate, the delay, the expense that’s eliminated because you are smart enough to learn about trust.
